HON'BLE SRI JUSTICE S.V. BHATT COMPANY APPLICATION No.5 OF 2016 ORDER:

The applicant/transferor company through the instant application prays for dispensing with the convening of meeting of shareholders and convening the meeting of unsecured creditors of transferor company. On 06.01.2016, while accepting the prayer for dispensing with the convening of meeting of shareholders, this Court directed the applicant to hold the meeting of unsecured creditors at 10.30 a.m. on 19.02.2016 under the chairmanship of court appointed commissioner. It is stated that the meeting was convened and the Advocate/Commissioner has filed report dated 25.02.2016.

Learned counsel for the applicant draws the attention of the Court to the resolution of all the unsecured creditors taken in the meeting convened on 19.02.2016.
