HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9007 of 2017 ORDER:

Heard the petitioner in person, learned Public Prosecutor for the 1st respondent and perused the record.

The petitioner has submitted that he is falsely implicated in this case, there are no grounds to proceed against him and also submitted that in the event of the Court not in agreement with him, the proceedings before the Court below may be expedited, by posting the case on weekly basis and the petitioner or his counsel may be allowed to cross-examine the witnesses on the same day. He also submitted that the Court below may be directed to dispose of the case within a period of two months. Learned Public Prosecutor would submit that there are substantial allegations of dowry harassment against the petitioner and other accused and there are no justifiable grounds to quash the proceedings.

It is evident from the record that there are specific allegations against the petitioner-accused with regard to commission of the offence under Section 498-A IPC etc. Therefore, it is not justifiable to quash the proceedings. However, in view of the submission made by the petitioner, the Judicial Magistrate of First Class, Palasa, is directed to dispose of C.C.No.94 of 2016 within a period of six (6) months from the date of this order.

The Criminal Petition is disposed of accordingly. As a sequel, miscellaneous petitions if any pending stand closed. ________________________ Dr. SHAMEEM AKTHER, J September 22, 2017 Note: Furnish C.C. in three days B.O.
