HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.15211 of 2013 ORDER:

This writ petition is filed to declare the action of the 1st respondent in making interim arrangements vide G.O.Rt.No.1014 dated 20.5.2013 as illegal and arbitrary.

The case of the petitioner is that he was appointed as Assistant Government Pleader for the Senior and Junior Civil Judge Court, Allagadda, Kurnool District, on 29.3.2010 for a period of three years and that the period would expire by 11.4.2012; before expiry of the said period, the 2nd respondent issued proceedings dated 3.4.2013 continuing the petitioner as Assistant Government Pleader; as per the said order, the petitioner will be continued as Assistant Government Pleader till a new candidate is appointed or till termination of the service of the petitioner; the 2nd respondent prepared a panel for appointment of Assistant Government Pleader and sent to the 1st respondent; the 1st respondent issued G.O.Rt.No.1014 dated 20.5.2013 making interim arrangements to the post of Assistant Government Pleader and appointed Sri A.

resignation, absence, expiry of term of law officer or where there is a necessity and urgency; due to political pressure, the 1st respondent issued G.O.Rt.No.1014 dated 20.5.2013 and the same is without jurisdiction. Counter affidavit has been filed by the 1st respondent stating that the panel for appointment of Assistant Government Pleader for the Senior and Junior Civil Judges' Courts, Allagadda, is received from the District Collector, Kurnool, on 20.6.2013 and the Government have appointed Sri R.Sreenath Reddy, Advocate as regular Assistant Government Pleader for the said court from the panel vide order issued in G.O.Rt.No.1874 dated 22.8.2013 and hence, the writ petition has become infructuous. In view of appointment of regular Assistant Government Pleader, the cause in the writ petition does not survive. Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs.
