THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Crl.P.M.P. Nos. 8563 and 8564 of 2015 and Criminal Petition No. 9925 of 2011 Order:
This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, by the petitioners/A-4 and A-5, seeking to quash the proceedings pending against them in CC No.305 of 2010 on the file of XIII Metropolitan Magistrate, Cyberabad, at L.B. Nagar, for the offences punishable under Sections 498-A, 420, 506 IPC and Sections 3 and 4 of the Dowry Prohibition Act.
2. Now, the petitioners/A-4 and A-5 and the second respondent/de facto complainant have filed CrlPMP Nos.8563 and 8564 of 2015 stating that they have settled the matter out of Court and, in view of that, they may be permitted to compound the offences and requested to quash the proceedings pending against the petitioners/A-4 and A-5 in CC No. 305 of 2010 on the file of XIII Metropolitan Magistrate, Cyberabad, at L.B. Nagar.
3. One Sri K. Sambasiva Rao, the GPA holder of the petitioners/A-4 and A-5, and the second respondent/de facto complainant as well as their counsel are present. The parties have filed a joint memo stating that they have voluntarily compromised the matter and, therefore, the quash petition filed by the petitioners/A-4 and A-5 may be allowed.
4. Having regard to the facts and circumstances of the case, the compromise is recorded and Crl.P.M.P. Nos. 8563 and 8564 of 2015
are allowed. Consequently, the Criminal Petition No.9925 of 2011 is allowed and the proceedings pending against the petitioners/A-4 and A-5 in CC No. 305 of 2010 on the file of XIII Metropolitan Magistrate, Cyberabad, at L.B. Nagar, are hereby quashed.
5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. __________________ M.S.K. JAISWAL, J.
