THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7847 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.3 and 4 in F.I.R.No.296 of 2023 on the file of Nirmal Town Police Station, Nirmal, registered for the offences under Sections 370 of IPC and Section 81 of the Juvenile Justice (Care and Protection of Children), Rules, 2007. 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The allegation against these petitioners is that they have adopted 11⁄2 month old child of A-1 and A-2 who have six children. However, it is alleged that the child was sold by A-1 and these petitioners have purchased this child for Rs.2,50,000/-. Thereafter, A-2 started demanding more money from these petitioners. Since these petitioners refused, a complaint was filed.

Petitioners are in jail since 03.08.2023. The child was taken by the Child Welfare Department. As seen from the remand report, petitioners have adopted the child. However, major part of the investigation is completed, for which reason, the petitioners can be granted relief of regular bail, subject to following conditions:

i) The petitioners/Accused Nos.3 and 4 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate at Nirmal.

ii) The petitioners/Accused Nos.3 and 4 after release shall appear before the concerned Station House Officer, as when required for the purpose of investigation.

iii) The petitioners/Accused Nos.3 and 4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
