P.K.Mehra, v. State Of Telangana
THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT APPEAL No. 1385 of 2016 JUDGMENT: (Per VRS,J) The writ appeal arises out of the refusal of the learned Judge to grant an interim suspension of an order of transfer. 2.
Heard Mr. K. Rama Subba Rao, learned counsel for the appellant.
3.
After the reorganization of the Districts, the Government passed two orders, one in G.O.Rt.No.342, Higher Education (IE) Department, dated 11.10.2016, and another in G.O.Rt.No.327, Higher Education (IE) Department, on the same date. By the first order, the appellant was transferred from Hyderabad District to Suryapet District. By the second order, the 4th respondent was posted to the place of the appellant.
4.
The grievance of the appellant, as projected before us, is not so much as to his transfer, but very much as to the entitlement of the 4th respondent to be posted to his place. In such circumstances, the learned Judge was right in refusing to grant an interim suspension.
VRS,J & GSP,J WA No.1385 of 2016 Hence, the Writ Appeal is dismissed. If the pleadings are complete, we request the learned Judge to expedite the hearing of the writ petition.
Consequently, miscellaneous petitions if any pending in the writ appeal shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J _____________________ G. SHYAM PRASAD, J 15th December, 2016 cbs
