HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.15113 OF 2016 ORDER:

This petition is filed under Section 482 of Cr.P.C. to recall N.B.Ws. issued against the petitioner by order dated 18-5-2016 in C.C.No.92 of 2016 by X Special Magistrate, Hyderabad. It is the case of petitioner that initially, the complaint was filed before XI Additional Chief Metropolitan Magistrate, Secunderabad and later it was transferred to VII Special Magistrate, Hastinapur and again transferred to X Additional Special Magistrate, Hyderabad, but transfer of this matter to X Additional Special Magistrate, Hyderabad is not known to the petitioner and thereby, he could not appear before the Court and therefore, court issued N.B.W. against the petitioner.

As the mater was transferred from one court to another, it is difficult for the petitioner to know the transfer proceedings before particular court. However, taking into consideration of explanation submitted by the petitioner, N.B.W. dated 18-5-2016 issued against the petitioner is hereby recalled on undertaking to appear before the court on future dates of adjournment.

Accordingly, this Criminal Petition is ordered. As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. ________________________________ JUSTICE M.SATYANARAYANA MURTHY Dated 25-10-2016.
