THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 14944 of 2015 ORDER:

It is submitted by the learned counsel for the petitioner that the petitioner comes under the category of Last Grade Employee such as Attenders and Measurers/Helpers who have to retire on completion of 60 years as per Rule 6 of the By-Laws of the Society.

2. From the designation indicated in the cause title, the petitioner is working as Assistant Salesman, and this Court has got a doubt whether he comes under the category of Last Grade Employee or not.

3. In the circumstances, the 2nd respondent shall consider the case of the petitioner with regard to the applicability of the Rules of Superannuation and pass appropriate orders thereon. Since this writ petition is filed challenging the action of 2nd respondent in issuing the impugned letter dated 03.05.2015 informing that the petitioner would attain the age of superannuation by 31.05.2015, and in view of the submissions made by the learned counsel for the petitioner, this Court is not inclined to keep the writ petition pending.

4. Hence, the writ petition is disposed of directing the 2nd respondent to consider the case of the petitioner as aforesaid. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
