THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.895 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "declaring the action of the 3rd Respondent in not mutating the names of the Petitioners in the revenue records, issue of pattadar pass books and title deeds over the land admeasuring an extent of Ac.9.84 cents in Sy.No.57/1 of Valasampeta Village, Koyyuru Mandal, Visakhapatnam District as illegal, arbitrary, abdication of the powers as conferred under the revenue laws consequently direct the Respondents 3 & 4 to mutate the names of the Petitioners in the relevant revenue records as lawful owners and title holders of the land admeasuring an Ac.9.84 cents of Valasampeta Village, Koyyuru Mandel, Visakhapatnam District."

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue. With their consent, the writ petition is disposed of at the stage of admission. 3.

A perusal of the material on record would disclose that the petitioners made an application for mutation of their names in the revenue records, pursuant to which, the Revenue Divisional Officer called for a report from the Tahsildar, who, after due enquiry, submitted a report on 27.07.2016.

It is the case of the petitioners that in spite of submission of report by the Tahsildar, till date no orders are passed by the 3rd respondent-Sub-Collector.

Learned Assistant Government Pleader for Revenue would submit that the Sub-Collector has no jurisdiction to pass the order basing on the report of the Tahsildar, dated 27.07.2016. 6.

Having regard to the above, the Writ Petition is disposed of directing the 3rd respondent-Sub-Collector to pass appropriate orders pursuant to the proceedings Rc.No.116/2015/SC, dated 27.07.2016, which the petitioners claim to be pending before him, in accordance with law, as early as possible, preferably within a period of eight (08) to twelve (12) weeks from the date of receipt of a copy of this order by taking into consideration the objections raised by the petitioners and also aggrieved persons, if any. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
