THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7838 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.728 of 2023 on the file of Narsingi Police Station, Cyberabad, registered for the offences under Sections 304 (ii) r/w. 109 of IPC and Section 25(1B) (b) of the Arms Act, 1959 and Sections 184 and 187 of MV Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The case of the prosecution is that this petitioner was driving a car along with three other friends. He drove the car rashly and ran over the pedestrians on the road resulting in the death of two persons.

The petitioner was arrested on 05.07.2023 and since then, he is in jail. As seen from the record, most part of the investigation is complete. Since it appears to be the case of accident that the petitioner was driving in a rash and negligent manner causing accident and consequent death, the petitioner can be granted the relief of regular bail, subject to following conditions: i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of XIII Additional Metropolitan Magistrate, Rajendra Nagar, Ranga Reddy District.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of eight weeks or until the charge sheet is filed, whichever is earlier.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
