HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.9746 OF 2009 ORDER:

The relief sought for in this Writ Petition is to declare the action of the Commissioner, GVMC in not taking any action pursuant to the representation made by the petitioner dated 20.04.2009, on the illegal and unauthorised construction made by respondents 2 and 3 in the land earmarked for common amenities, as per the provisions of the HMC Act, as arbitrary and illegal.

By way of an interim order in WPMP No.12675 of 2009 dated 01.05.2009, this Court directed respondents 2 and 3 not to make any construction until further orders. As the relief sought for in the Writ Petition is only to have their representation dated 20.04.2009 considered in accordance with law, suffice it to dispose of the Writ Petition directing the first respondent to take action on the petitioner's representation dated 20.04.2009 in accordance with law and communicate their decision to the petitoner at the earliest, and in any event, within three months from the date of receipt of a copy of this order. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.
