The Court made the following:

ORDER:

This Writ Petition is filed questioning the inaction of respondent No.2 in not staying order dated 16-9-2011 in Rc.No.377/CSDT/11, whereby respondent No.3 has suspended the petitioner's fair price shop authorization for a period of 90 days.

At the hearing, there is no representation for the petitioner. Inasmuch by order dated 16-9-2011 respondent No.3 has suspended the petitioner's authorization for a period of 90 days, it has ceased to exist with the efflux of time. Hence, the Writ Petition

has become infructuous and the same is accordingly dismissed as such.

As a sequel to the dismissal of the Writ Petition, WPMP No.34360 of 2011 is dismissed of as infructuous.
