When the matter was listed for hearing on 01.08.2016, as there was no representation for the appellant, whereas the contesting 1st respondent was represented by a counsel, Registry was directed to list the matter on 02.08.2016, under the caption "FOR DISMISSAL".

2. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.

3. Hence, the appeal is dismissed for non-prosecution. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
