HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36454 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the 3rd respondent in permitting his officials for harassing the petitioner by their unlawful interference and obstruction into his lawful business, without there being any case against the petitioner, as illegal and arbitrary.
Heard and perused the material available on record. The grievance of the petitioner is that he is running a Beef shop and there are civil disputes pending between him and the 6th respondent and at the instigation of the 6th respondent, the police officials are forcing him to close his shop and not permitting him to carry on his business. Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes. Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
" The 3rd respondent is directed not to interfere with the affairs of the petitioner and the 6th respondent, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioner for cognizable offence." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J October 28, 2016 KTL
