THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34854 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed to declare the action of respondents 2 & 5 in harassing and threatening the petitioners and parents of the 2nd petitioner, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioners is that petitioners are wife and husband and from the date of marriage, they led marital life in Kingdom of Saudi Arabia, and thereafter the 1st petitioner went to Pakisthan and the 2nd petitioner went to Indonesia and came back to India in the year 2012. Then the 2nd petitioner sponsored spouse visa to his wife and then she came to India on 08.08.2016.

Thereafter, the petitioners approached the 3rd respondent and submitted an application to issue residential permit and the 3rd respondent issued residential permit in favour of the petitioners on 11.08.2016 which is valid till 07.09.2016. Later, even before the expiry of the said permit, the 1st petitioner has submitted an application to the 3rd respondent on 27.08.2016 requesting to extend the period of her stay in India, i.e., for a period of one year and the same is under consideration.

The main grievance of the petitioners is that respondents 3 & 5 are interfering with the affairs of the petitioners and the 5th respondent is directing the petitioners to leave India since their period of stay in India is over by 07.09.2016. Hence, the petitioners prayed this Court to direct the 5th respondent not to interfere till the disposal of the representation of the petitioner, dated 27.08.2016 by the 3rd respondent. Considering the said facts and circumstances of the case, the 3rd respondent is directed to dispose of the representation of the petitioner,

dated 27.08.2016, on or before 30.11.2016. Until then, respondents 3 & 5 are directed not to interfere with the affairs of the petitioners. Accordingly, the Writ Petition is disposed of. No costs.
