THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24898 OF 2005 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to declare that the petitioner is entitled for absorption in the aided post of the third respondent institution with effect from 01.01.2000 and the action of the second respondent in absorbing the petitioner with effect from 15.05.2004 (to that extent) is illegal, arbitrary, discriminatory and violative of Articles 14, 16 and 21 of the Constitution of India and further declare that the action of the first respondent in not extending the benefit that was given to the persons covered by proceedings in Rc.No.1211/D1-3/99 dated 24.01.2005, is illegal, discriminatory and violative of Articles 14 and 16 of the Constitution of India.

At the time of arguments, the learned counsel for the petitioner and the learned Government Pleader for School Education submitted that the second respondent submitted the proposal dated 25.11.2004 vide Rc.No.1448/A6/2000 to the first respondent and the said proposal is pending before the first respondent. Therefore, the first respondent may be directed to dispose of the proposal dated 25.11.2004 sent by the second respondent.

In view of the submission made by the learned counsel for both parties, the first respondent is hereby directed to pass appropriate orders on the proposal of the second respondent dated 25.11.2004, as expeditiously as possible, preferably within a period of four (4) months from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
