THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 5896 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure to quash the proceedings in crime No. 55 of 2018 of Jannaram Police Station, Mancherial District, registered for the offences punishable under Sections 448, 290, 506, 427 IPC and under Sections 3 (1) (s), 3 (2) (va) of SCs and STs ( POA) Act, 1989.

After arguing the case for awhile, learned counsel for the petitioners has requested this Court to direct the concerned S.H.O. to follow the guidelines laid down by the Apex Court in Dr. Subhash Kashinath Mahajan Vs. State of Maharashtra1.

Acceding to the request of learned counsel for the petitioners, without touching the merits of the case, I find that it is a fit case to issue direction to the police to follow the procedure laid down by the Apex Court in Dr. Subhash Kashinath Mahajan (supra). Accordingly, the police concerned are directed to adhere to the guidelines issued in Dr. Subhash Kashinath Mahajan (supra).

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
