HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU APPEAL SUIT No.872 of 1999 JUDGMENT:

Even earlier on 08.11.2017 and 22.11.2017, it is made clear that further time cannot be granted. However, learned counsel for the appellants sought time on the ground that paper books are not ready. Again on 30.11.2017 there was no representation on behalf of the appellants and the matter was posted on 7.12.2017 under the caption "for Dismissal". From 07.12.2017, it was adjourned to 08.12.2017, despite lack of representation on behalf of the appellants. Today, the learned counsel for the respondents states vehemently that the appellant has taken adequate time and is not evincing any interest in arguing the matter.

In view of what is noted it appears that the appellant is not keen in arguing the matter.

Hence, in view of the above, the appeal is dismissed for nonprosecution. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this appeal shall stand closed.
