HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.13019 of 2017 Order:

This Writ Petition is filed challenging the registration of FIR No.21 of 2017 on the file of B. Mattam Police Station, B. Mattam, YSR Kadapa District by the second respondent on the complaint made by the third respondent.

The third respondent lodged a complaint stating that the petitioner dismantled the APSRTC bus shelter and occupied the place unauthorizedly. It is also stated that the petitioner raised pillars up to ground level.

Learned counsel for the petitioner submits that the land on which the shed was constructed belonging to the petitioner and it is being used by the passengers as a bus shelter. The petitioner is having all the documents showing his title and possession to the said land. Be that as it may, it is a matter for investigation by the police and it is hoped that the police would look into this aspect of the matter while investigating the case.

In the circumstances, this Writ Petition is disposed of directing the second respondent to continue the investigation pursuant to registration of crime strictly following due process of law including compliance with Section 41-A of the Code of Criminal Procedure, 1973. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
