HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.1787 of 2016 ORDER:

The petitioners, who are accused Nos.1 and 2, filed the present application under Sections 437 and 439 Cr.P.C. seeking bail in Crime No.75 of 2015 of Butchiyyapeta Police Station, Visakhapatnam Rural, Visakhapatnam District, registered for the offences punishable under 20 (b) (i) read with 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

When the matter is taken up for hearing the learned counsel for the petitioners submits that though 90 days period has elapsed the police have not yet filed the charge sheet as such the petitioners are entitled for statutory bail. That being so, the petitioner shall move an application before the appropriate Court, in which event the same shall be dealt with on the same day.
