THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10104 of 2015 ORDER:
This Criminal Petition is filed by the petitioner - accused, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.55 of 2011 on the file of CID, Hyderabad, registered for the offences punishable under Sections 420, 468, 471 and 182 IPC and 10, 11 and 12 of the (SC/ST/BC) Regulation of issuance of Community Certificate Act, 1993.
Heard and perused the material available on record. The allegation against the petitioner is that he got employment as a Scientific Assistant in Heavy Water Plant, Baroda in Gujarat State, on the basis of BC-D caste certificate, which is a forged one.
Learned counsel for the petitioner submitted that against the order of cancellation of the caste certificate by the Tahsilder, the petitioner filed a writ petition and the same was disposed of by this Court directing the competent authority to dispose of the appeal pending before it, and the appeal is pending before the Government. Considering the facts and circumstances of the case and also the entire case is based on documents, this Court is of the view that grant of anticipatory bail to the petitioner would not cause any prejudice to the investigation. In the circumstances, the petitioner - accused is directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, he shall be released on bail on his executing a personal bond for a sum of Rs.
25,000/- (Rupees twenty five thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. Further, the petitioner is directed to appear before the Station House Officer concerned, daily between 10 a.m. and 5 p.m. for a period of ten (10) days, from the date of receipt of a copy of this order. Accordingly, the Criminal Petition is allowed.
