HON'BLE DR. JUSTICE B. SIVA SANKARA RAO Criminal Petition No.3311 of 2017 ORDER:

The petitioner is the sole accused of Crime No.152 of 2017 of Station House Officer, Mahabubabad Town Police, Mahabubabad District, registered for the offences punishable under Section 354A IPC, Section 7 read with Section 8 of Protection of Children from Sexual Offences Act, 2012 (for short 'POSCO Act'). The 2nd respondent is the defacto complainant.

2) The report dated 20.02.2017 registered as crime supra shows that the incident occurred at Kattelamande School, Signal Colony, Mahabubabad for past more than two months. The contents of the report reads that the defacto complainant is working as attender of the school. For that school, among the two teachers, one is head master and another is accused-J.Prathap, who is working as teacher harassing her sexually for the past two months. While so, on the fateful day of 20.02.2017, Mandal Educational Officer visited the school and enquired into it, all the children stated that the accused was putting hands on the waist of the children and behaving indecently. When the defacto complainant having lunch, he came and sitting behind her harassing her stating that come to khammam or some other place for spending and even putting blue films through mobile internet and showing to the children and defacto complainant and harassing her and even taking their photos without their consent even head master reprimanded him, he did not change his attitude. Hence to take action.

Dr.SSRB,J Crlp_3311_2017 3) The police investigation, from registration of the crime, shows that there is accusation against the petitioner/ accused. Thereby, there is nothing to quash the criminal proceeding or interdict the investigation but for to say the police shall investigate and file final report as early as possible.

4) Accordingly and in the result, the Criminal Petition is disposed of leaving it open to the petitioner to avail all the defences available under law.

5) Miscellaneous petitions, pending if any in this Criminal Petition shall stand closed.
