AMARNATH GOUD WRI T PETI TI ON No.18917 of 2018 ORDER: (per SK, J) The prayer of the petitioner company in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or Order or Orders more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in issuing the Impugned Notice for sale of land admeasuring Acs.29.11 Guntas in Sy.Nos.18, 19, 20, 21(Part), Yavapur Village, Sadashivpet Mandal including land, building, plant and machinery scrap of the Petitioner Company, in Form 7A vide Sangareddy District Gazette No.31 dated 30.04.2018 signed on 15.05.

2018 by Deputy Commercial Tax OfficerI, Sangareddy squarely in contravention to Sections 25, 27 and 36 of the Telangana Revenue Recovery Act, 1864, as being arbitrary, illegal and being violative of Articles 14, 19(1)(g) and 300A of the Constitution of India and violative of principles of natural justice and pass such other order or orders in the interest of justice as this Hon'ble Court deems fit and proper and to pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case."

No interim orders were granted by this Court though the matter underwent as many as four adjournments.

The sale proposed to be held under the impugned notice of sale of land dated 30.04.2018 was on 07.06.2018.

Sri D. Narendar Naik, learned counsel for the petitioner company, would inform this Court that the sale did not materialize on 07.06.2018.

SK, J & TA, J WP.No.18917 of 2018 In that view of the matter, challenge to the impugned notice of sale of land is rendered purely academic and does not warrant consideration on merits.

The writ petition is closed on that short ground leaving all issues open.
