Mara Maniks v. M/S Dhanvi Fashions
HON'BLE SRI JUSTICE Dr. B. SIVA SANKARA RAO CIVIL REVISION PETITION No.204 of 2017 ORDER:
This revision is filed by the petitioners/ defendants, aggrieved by the judgment dated 10.09.2015 in C.M.A.No.39 of 2014, wherein the Principal District Judge, Nizamabad, confirmed the order dated 25.11.2014 in I.A.No.798 of 2014 in O.S.No.232 of 2014 passed by the learned Senior Civil Judge, Nizamabad.
2.
Heard both sides and perused the impugned order and the grounds urged in the revision.
3.
The plaintiff, who is the respondent herein filed the above suit for prohibitory injunction. Pending the suit, he filed I.A.No.798 of 2014 for temporary injunction and the trial Court vide its order dated 25.11.2014 granted temporary injunction restraining the petitioners herein and their men from interfering with the possession of the suit premises, pending disposal of the suit. Against which, the defendants preferred an appeal in CMA No.39 of 2014 before the Principal District Judge, Nizamabad, and the same was dismissed on 10.09.2015. Aggrieved by the same, the defendants preferred this revision.
4.
A perusal of the impugned judgment no way requires interference by this Court, that too, while sitting against the same, some other view is also possible when such is not the ground, but for, to say, none of the observations of the Courts below no way influence the mind of the trial Court in deciding the suit. As the suit is of the year 2014, the trial Court is directed to dispose of the same as early as possible, subject to other preferences and at any cost within a period of six months from the date of receipt of copy of this order. 5.
Accordingly, the Civil Revision Petition is disposed of. 6.
Consequently, miscellaneous petitions, if any shall stand closed. No order as to costs.
