HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32495 of 2011 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the main writ petition is being heard. The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of the respondents in not considering the representation dated 03.01.2007 and another dated nil, made by the petitioner for grant of assignment in respect of land admeasuring Ac.3.00 cents situated in Sy.No.10 of Lingalavalasa Village, Gajapathynagaram Mandal, Vizianagaram District, as arbitrary, illegal and violative of principles of natural justice.

The averments in the affidavit filed in support of the writ petition are as under:

The petitioner who claims herself to be a landless poor is a resident of Zinam Village. It is stated that the petitioner is in possession of Ac.3.00 cents situated in Sy.No.10 of Lingalavalasa Village, Gajapathynagaram Mandal and cultivating the said land for the past 30 years. Except the said land, she and her family have no other land and the entire family is dependent on the said land. It is stated that the land in Sy.No.10 is government land and classified as "Anadina Metta, Varshadram (rain fed)" and the same is to an extent of Ac.4.28 cents. It is stated that the petitioner belong to Scheduled Caste community and eligible for grant of assignment. She made an application to the respondents, but the

same was neither considered nor rejected. Since last five years the petitioner made several representations and also made available the copies of the representation i.e., 03.01.2007 and another dated -nil-. Questioning the inaction of the respondents in considering the representations made by the petitioner for grant of assignment, the present writ petition is filed. Though the petitioner claiming various reliefs but her main grievance is that the representation dated 03.01.2007 made to the respondents is not considered till date and hence seeks a direction.

Having regard to the circumstances stated above and taking into consideration the nature of averments made in the writ petition, the respondents are directed to consider the representation dated 03.01.2007, if any made and still pending, and pass orders in accordance with law within a period of twelve

(12) weeks from the date of receipt a copy of this order. With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
