Heard the learned counsel for the petitioners and the learned Public Prosecutor.
2. The present Criminal Petition came to be filed under Section 482 of the Code of Criminal Procedure, 1973, by the petitioners seeking modification of the Order, dated 02.08.2016, passed in Crl.M.P.No.2002 of 2016 in Crime No.129 of 2014 of II Town Police Station, Visakhapatnam, registered for the offences punishable under Sections 420, 406 IPC and Section 5 of the A.P. Protection of Depositors of Financial Establishment Act, 1999, by the Metropolitan Sessions Judge-cum-I Additional District Judge at Visakhapatnam.
3. The Court below while granting anticipatory bail to the petitioners directed them to furnish two Government sureties along with other conditions.
4. The grievance of the petitioners is that it has become very difficult for them to get Government sureties and if the condition is not modified, the petitioners would be put to irreparable loss.
5. Having regard to the facts and circumstances of the case, the condition of furnishing Government sureties is concerned, is modified as under:
The petitioners shall furnish two sureties of Rs.10,000/- each for a like sum each. Out of which, one surety must be from Visakhapatnam and another surety must be from the native place
of the petitioners. Both the sureties shall produce proof of their residence and the Magistrate concerned shall verify the antecedents and proof of residence of the sureties before accepting them. All other conditions shall remain un-challenged.
