Mutyala Sai Kumar v. Mr. Rajasekhar,
THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.261 OF 2016
O R D E R
This contempt case was instituted alleging willful disobedience to the order dated 08.12.2015 passed by this Court in W.P.No.32995 of 2013. By the said order, this Court permitted the petitioners therein to make a detailed representation to the concerned police authorities seeking closure of the rowdy sheets opened in their names and the police authorities were directed to consider the said representations and take a decision as to whether the rowdy sheets opened in the names of the petitioners required further extension and if so, communicate the same by way of reasoned order.
The Sub-Divisional Police Officer, Peddapuram, East Godavari District, filed a counter-affidavit stating that pursuant to the order passed by this Court insofar as it relates to the petitioner in this contempt case, a decision was taken to continue the rowdy sheet opened in his name and the required reasoned order was also sought to be communicated to him but, as he was absconding and the police could not trace him out, it was not served. A copy of the police notice signed on 29.01.2016 addressed to the petitioner is placed on record. In the light of the aforestated facts, this Court finds no disobedience, much less willful disobedience, to the order passed in W.P.No.32995 of 2013 warranting exercise of contempt jurisdiction. The contempt case is accordingly closed. No order as to costs.
