HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 25433 of 2017 Order:

This Writ Petition is filed challenging the action of the respondents in acquiring the agricultural patta lands of the petitioners for formation of road and tollgate in the petitioners lands pursuant to the notification published on 04.07.2017.

The petitioners state that they have submitted their objections to the said proposed acquisition on 11.07.2017 and 19.07.2017 and they are apprehending that the lands would be acquired without considering their objections.

Since no declaration is published in the newspapers or in the Gazette, this Court cannot examine the apprehension of the petitioners. It is needless to observe that the competent authority shall consider the objections filed by the petitioners before taking a decision with regard to acquisition of the lands of the petitioners for the aforesaid purpose pursuant to the notification dated 04.07.2017. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
