ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as a Fair Price Shop Dealer for shop No. 41 of A.Kattamuru village, Sattenapalli Mandal, Guntur District on permanent basis. She received the essential commodities for the month of March, 2015. While so, on 18.03.2015 the Mandal Revenue Inspector along with his staff inspected the shop of the petitioner and did not find any variations in the stock. However, the petitioner was surprised to receive the impugned order dated 30.03.2015 suspending the authorization on the ground that the petitioner committed

certain irregularities in distribution of essential commodities to the card holders and diverted of 1.72 quintals of PDS rice to black market. Challenging the same, the present Writ Petition is filed.

I have carefully perused the impugned order which contains details of 15 cardholders. The Deputy Tahsildar (Civil Supplies ) and Village Revenue Officer appear to have enquired some of the card holders and recorded their statements. The allegations made against the petitioner require to be enquired into and a finding has to be recorded there on. In these circumstances, this Court is not inclined to interfere with the impugned order dated 30.03.2015 at this stage. However, the second respondent is directed to complete the enquiry within a period of sixty days from the date of receipt of a copy of this order by duly observing the principles of natural justice. The petitioner is given fifteen days time to submit her explanation to the charges levelled against her.

The Writ Petition is accordingly disposed of. As a sequel thereto, miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs. --------------------------------------------------- JUSTICE A.RAMALINGESWARA RAO Dated 1st July, 2015.
