THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.34554 OF 2016 ORDER:

Heard Sri N.Subba Rao, the learned counsel for the petitioner, the learned Government Pleader for Irrigation representing respondent Nos.1 to 3 and the learned Government Pleader for Revenue representing respondent Nos.4 and 5. 2.

It is the case of the petitioner that there is a water tank in Survey Nos.813, 814 and 185 of Bommakal Village, Karimnagar Mandal, Karimnagar District. The tank is also called as 'Mallaiah Cheruvu'. It is the further case of the petitioner that respondent Nos.6 to 13 have encroached the tank without any right whatsoever. A perusal of the record reveals that the petitioner submitted a representation to respondent Nos.4 and 5 on 12.09.2016 with a request to protect the Mallaiah Cheruvu. For one reason or other, respondent Nos.4 and 5 have not disposed of the said representation of the petitioner.

At the time of arguments, the only relief sought for by the learned counsel for the petitioner is to direct the fourth respondent to consider and dispose of the representation of the petitioner. The learned Government Pleader also consented for the same. 4.

In view of the submissions made by the learned counsel for both parties, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both parties,

the fourth respondent is hereby directed to consider and dispose of the representation of the petitioner dated 12.09.2016 in accordance with law, after affording a reasonable notice to respondent Nos.6 to 13, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
