HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.539 OF 2017 ORDR:
The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners - accused Nos.1 to 4 viz., Jetti Venkataratnam alias Rataiah, Pilli Isaac, Mekala Jayaraj and Tadi Koteshwer Rao, requesting to quash the proceedings against them in First Information Report No.180 of 2016 of Tenali II Town Police Station, Guntur Rural District, for the offences punishable under Sections 447 and 427 read with Section 34 of the Indian Penal Code, 1860.
2. Heard Sri K. Venumadhav, learned counsel for the petitioners, and the learned Additional Public Prosecutor for the State of Andhra Pradesh, and perused the material on record.
3. The learned counsel for the petitioners, in fact, draws attention of this Court to the complaint and tries to make out a case that there was no destruction of the crop raised by the de facto complainant - respondent No.2 herein, but it is not so on an intrinsic examination of the complaint averments. Therefore, it cannot be said that no prima facie case is made out against the petitioners for the offences alleged against them.
Therefore, the Criminal Petition is dismissed, at the admission stage itself.
