THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.21740 OF 2006 ORDER:

No representation for petitioner as well as respondents. The petitioner challenges Lr.No.RECS/ CPL/ E co(o)/ 318/ 06-07 dated 07.06.2006 of the 1st respondent, as illegal, arbitrary and unconstitutional.

The 1st respondent through impugned letter declined to admit the petitioner on the ground that the petitioner is not an employee of RECS. On 13.02.2006, the following interim direction has been issued.

" Though a counter affidavit is filed stating that the Gram Panchayat has not permitted the petitioner to join duty after recovering from ill-health, the learned counsel for the petitioner placed a letter dated 26.12.2006 showing that the Gram Panchayat has passed a resolution permitting the petitioner to join duty as Village Electrical Worker.

Under these circumstances, there shall be interim direction to the respondents to continue the petitioner in service and to pay the salary regularly, until further orders." The interim direction subsists as on date. Therefore, the grievance of petitioner that he is not admitted to duty is substantially redressed and this Court is the view that the writ petition can be disposed of by making the interim direction as final order. The writ petition is, accordingly, disposed of. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
