HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.6903 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies (AP).

2. This writ petition is filed seeking Writ of Mandamus declaring the action of the 3rd respondent in suspending the authorisation of the petitioner's fair price shop No.2, situated at Atmakur Village and Mandal, Anantapuram District, vide proceedings dated 04.03.2015 on flimsy grounds without considering the explanations submitted by the petitioner and without following due procedure contemplated under law, as illegal and arbitrary and for a consequential direction to the respondents to release the essential commodities to the petitioner's fair price shop.

The authorisation of the petitioner's fair price shop was suspended by the 3rd respondent-Revenue Divisional Officer, Ananthapuram on 04.03.2015 allegedly on the ground that during the inspection conducted by the revenue officials, certain variations in the stock of commodities have been noticed. Learned counsel appearing for the petitioner submits that the variations alleged against the petitioner are within the permissible limit and therefore, the order of suspension is required to be set aside.

Since the order of suspension was passed on 04.03.2015 pending enquiry by the 3rd respondent-Revenue Divisional Officer, Ananthapuram, this Court is not inclined to go in to the merits of the impugned order. In the circumstances, the 3rd respondent-Revenue Divisional Officer, Ananthapuramu is directed to conduct enquiry and pass final orders within a period of eight weeks from the date of receipt of a copy of this order.
