The petitioner retired from service on attaining the age of superannuation on 31.5.2012. It appears two disciplinary proceedings were initiated before his retirement. In one disciplinary proceedings, punishment of stoppage of one annual grade increment without cumulative effect was imposed and status of another disciplinary proceedings is not known to the petitioner. The petitioner is the accused in C.C.No.1 of 2011 on the file of the Principal Special Court for SPE & ACB Cases cum IV Additional Chief Judge, City Civil Court, Hyderabad. Due to pendency of criminal case, he was granted only provisional pension. The Criminal Court rendered judgment on 30.11.2017 acquitting the petitioner. After the acquittal, the petitioner made representation on 17.1.2018 praying to release all the retirement benefits and full pension.
Alleging inaction, this Writ Petition is filed. Since representation came to have been filed and acknowledgement of submission of representation is annexed to the Writ Petition, without expressing any opinion, this Writ Petition is disposed of directing the 1st respondent to examine the claim of the petitioner for release of full pension and other retirement benefits as ventilated in his representation, as warranted by law, within eight weeks from the date of this order.
Pending miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
