Heard.

Petitioners' complain of unlawful interference by respondents 3 and 4 and repeatedly calling them to Police Station with regard to land admeasuring Ac.1.00 in Survey No.1/1 of Raviryal Village, Maheshwaram Mandal, Ranga Reddy District, and also complain of not taking any appropriate action on their complaint, dated 10.04.2015.

Learned Government Pleader for Home has already received instructions from respondents 3 and 4 and Mr. P. Ravi Shankar, learned counsel appearing for respondent No.5.

It is evident from the instructions received by learned Government Pleader that respondent No.5 lodged a complaint on 25.03.2015, and the petitioners also lodged a complaint. Since both the complaints are against each other, respondents 3 and 4 state that they called both the parties and after enquiry it was noticed that O.S.No.1274 of 2014 is pending between them before the VII Additional Senior Civil Judge, Ranga Reddy District, in which I.A.No.874 of 2014 seeking temporary injunction is also pending. It is further stated that respondents 3 and 4, after examining both the parties and after conducting preliminary enquiry, found that the dispute between the petitioners and respondent No.5 is subject matter of the said suit and is purely a civil matter with which they cannot interfere.

However, to the extent of maintaining law and order to keep peace and tranquillity in the area, the respondent Police will take appropriate steps. In view of the above, since civil suit between the petitioners and respondent No.5 is pending, the respondent Police are at liberty to maintain law and order as the peace and tranquillity is required to be maintained by them. Since investigation is pending, no further directions are called for in this Writ Petition. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
