HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE R. KANTHA RAO Writ Appeal No.300 of 2016 JUDGMENT: (per Hon'ble Sri Justice V. Ramasubramanian) The appellant, whose application for appointment to the post of Junior Lecturer in English on contract basis, was not considered by the respondents on the ground that the University from which he obtained a decree has been de-recognized, filed W.P.No.17178 of 2009 seeking appropriate reliefs. But the writ petition was dismissed by the learned Judge, with an observation that if the de-recognition is subsequently withdrawn, it is always open to the appellant to make an application afresh. Aggrieved by the said order, the writ petitioner is on appeal before us.
2. Heard Sri M.A.K.Mukheed, learned counsel for the appellant.
3. Admittedly, the notification for recruitment was issued on 28.07.2009. The notification prescribed the qualification of a PostGraduation degree in English. The appellant admittedly obtained such a degree through distance education from Kalinga University, Raipur, Chattisgarh State. This university was admittedly de-recognized by the University Grants Commission. Therefore, the learned Judge was right in holding that the respondents could not have considered the application of the appellant, especially, when the qualification prescribed for the post, had been obtained by him through the distance education from a de-recognized university.
4. Hence, we find no grounds to interfere with the order of the learned Judge. Therefore, the writ appeal is dismissed. There is no order as to costs. Pending miscellaneous applications if any, in this writ appeal shall stand closed.
