This petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in issuing the proceedings dated 02.02.2017 vide No.C/224/2017 in respect of the lands admeasuring Ac.2.07 guntas in Sy.No.233/1 and 233/2 situated at Abdullapur Village, Abdullapurmet Mandal, R.R.District, as illegal and arbitrary.
Learned counsel for the petitioners submits that petitioners were not issued notice before passing the impugned order.
Heard the learned Assistant Government Pleader for Revenue.
A reading of the impugned order goes to show that notices were not served on the petitioners before passing the impugned order, but they were affixed on the notice board of Grampanchayat.
In view of the same, the impugned order is set aside and the 3rd respondent is directed to serve copies of notices on the petitioners and also send the same to the addresses given in the cause title of the writ petition. Thereafter, it is open for the petitioners to file their objections within a period of four
(04) weeks from today. On receipt of the objections, the 3rd respondent shall consider the same and pass final orders, after affording an opportunity of hearing to the petitioners.
Till passing of final orders, there shall be stay of dispossession of the petitioners from subject land. If petitioners does not cooperate, it is open for the respondents to take appropriate action under law. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 25.04.2017 dv
