HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.19117 of 2018 ORDER:

This writ petition is filed to declare the action of respondents 1 to 10 in not considering the representations made by the petitioner against respondents 11 to 14 for atrocities, harassment and damage, demolition to the property of the petitioner in H.No.11-40/d, to the extent No.13 guntas in Sy.No.401 of Mandamarri Village, Mancherial District.

Telangana State including the laying of the road by respondents 11 to 14 from the land of the petitioner for the purpose of their layout and venture, which is against permission from the municipal authority as illegal and arbitrary.

Learned Assistant Government Pleader for Home produced written instructions stating that on the complaint of mother of the petitioner by name Kandukuri Laxmi W/o.Kandukuri Narsaiah a case in Cr.No.27 of 2017 was registered for the offences punishable under Sections 447, 290, 323, 506 read with Section 34 IPC against respondents 11 to 13/A-1 to 3 regarding criminal trespass into her land and prima facie case is also established against the accused and after completion of investigation into the case, charge-sheet is filed and the same was registered as C.C.No.259 of 2017 on the file of I Additional Judicial Magistrate of First Class, Mancherial. On the complaint of the petitioner, one more case in Cr.No.38 of 2018 was registered on 02-03-2018. As there is

no evidence found against the accused in the FIR, police sought to refer the case as 'false' and after obtaining permission, final report will be filed. Regarding complaint made on 07-05-2018 by the petitioner, no acknowledgment is produced by the petitioner.

Recording the same, the writ petition is disposed of. However, if the petitioner is still aggrieved that unofficial respondents are interfering and trespassing into his land, it is open for the petitioner to make fresh complaint to the concerned Station House Officer (SHO) and the concerned SHO shall take appropriate action in the matter accordingly in accordance with law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
