.....Respondent ORAL ORDER This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.108 of 2026 before the Jubilee Hills Police Station, Hyderabad, registered for the offence punishable under Section 316(4) and 318(4) of BNS.

The brief facts of the case are that the de facto complainant lodged a complaint before the police stating that the petitioner was employed in their company as Assistant Manager from the period 04.11.2020 to 16.12.2024 and on 16.12.2024 he resigned from the Company citing better career prospects. It was alleged that during his tenure, he was entrusted with critical responsibilities including maintenance of financial accounts, books of accounts, payments and financial records, and for the said purposes, he had complete access to the financial data of the company. It was specifically alleged that the petitioner is responsible for serious financial irregularities and discrepancies, wherein, the payments amounting to Rs.42,00,000/- approximately, were unlawfully diverted to accounts known to petitioner. As such, on registration of crime, the petitioner was arrayed as accused and the petitioner was arrested on 06.06.2026.

Heard Sri K. Uday Kumar, learned counsel for petitioner, and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that petitioner is innocent of the offences as alleged, and is falsely

implicated in the case. He contended that though the offences alleged against the petitioner are punishable for less than seven years, he was unlawfully arrested without assigning any apt reasons. While advocating that the petitioner had been languishing in jail since 06.06.2026 and the material part of investigation being complete, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition. 5.

Learned Additional Public Prosecutor opposes the bail application, contending that the allegations leveled against the petitioner are of serious nature and while averring that as the misappropriated amount is huge sum of Rs.42,00,000/-, the investigation is not yet completed, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 06.06.2026, the material part of investigation seems to be completed as LWs.1 to are examined, including the investigating authority.

Considering the facts and circumstances of the case, the progress in the investigation and the incarceration period of the

petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the XVII Additional Chief Judicial Magistrate, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
