THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41614 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the inaction of the second respondent in granting legal protection to protect the household property of the petitioner in survey No.135 situated at Mulkalla Village of Mancherial Mandal and District (Old Adilabad District) by taking action against the third respondent, who is violating court orders held in favour of the petitioner, as arbitrary and illegal, and consequently to direct the second respondent to grant police aid to the petitioner against unofficial respondent as per law. Heard and perused the material.
Learned counsel for the petitioner submits that the revenue officials issued proceedings mutating the name of the third respondent at the instance of the third respondent and that originally, the said property is mutated in the name of the wife of the petitioner. The petitioner filed a writ petition before this Court challenging the said proceedings and this Court passed interim order suspending the said proceedings. Aggrieved thereby, the third respondent is interfering with the possession of the petitioner and also he is attacking the petitioner and his family members. Hence, the petitioner made a written complaint, dated 04.11.2016, to the second respondent, but the second respondent is not providing any police aid to the petitioner and his family members as well as the property of the petitioner.
Considering the facts and circumstances of the case, the second respondent is directed to consider the representation dated 04.11.2016 submitted by the petitioner and provide police protection to the life and property of the petitioner if the second respondent is of the view that there is any necessity to provide police protection.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 30.11.2016 pln
