HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.10622 of 2007 ORDER :

The instant writ petition is filed seeking Mandamus, directing the respondents to permit the petitioner to participate in the selection process for the post of Contract Junior Lineman in pursuance of the Notifications dated 07.10.2005 and 13th and 14th February, 2006, inviting applications for the said posts in Nizamabad District, with all consequential benefits by holding the action of the respondents in not considering the claim of the petitioner for selection and appointment to the said post on untenable ground that he had not possessed the ITI qualification, even though, the petitioner possess the said qualification, at the time of initial appointment as Contract Labour and working for over 10 years and gained much experience in the said post, as illegal and arbitrary.

When the matter is called for hearing, learned counsel for the petitioner would represent that the cause in the writ petition does not survive for adjudication and the writ petition has become infructuous.

Perused the contents of affidavit filed in support of the writ petition.

While admitting the writ petition, by order dated 16.05.2007, in WPMP.No.13368 of 2007, this Court gave an

ASN,J W.P.No.10622 of 2007 interim direction to the respondents to consider the case of the petitioner for the post of Junior Lineman along with others, as per law.

Since the interview was held in the year 2006, and even interim direction was also given, the cause in the writ petition does not survive for adjudication and the writ petition has become infructuous.

Accordingly, the writ petition is dismissed as infructuous. Interim order dated 16.05.2007 stands vacated. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
