HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 18245 of 2016 Order:

The husband of the petitioner was appointed as a Mechanic in the first respondent-Corporation. He was terminated from service by an order dated 10.04.2007 for his unauthorized absence from 01.03.2006 to 03.07.2006 and from 02.08.2006 to 09.08.2006. He challenged the same in ID No.16 of 2009 before the Labour Court, Visakhapatnam and the same was allowed on 26.05.2012 by passing an award directing the management to reinstate him into service without back wages but with continuity of service and imposing punishment of deferring his annual increments for a period of two years with cumulative effect besides treating his suspension period as not on duty for the purpose of leave and increments. He expired on 19.05.2012 after the above case was reserved for orders. The petitioner submitted several representations for payment of terminal benefits and also for providing employment on compassionate grounds. When no action was taken, the present Writ Petition was filed.

When the matter is taken up for admission, learned Standing Counsel for the respondents-Corporation produced before this Court a copy of the order dated 12.07.2016 addressed to the Law Officer, Hyderabad, wherein it was stated that the Senior Law Officer opined that the settlements shall be made on the last pay drawn as if the employee died in service and also advised to comply with the award. A letter was issued to the petitioner on 04.07.2016 to attend the office for signing the settlement claim forms.

3. Now the learned counsel for the petitioner submits that the claim forms were filed on 26.07.2016.

4. In view of the same and in view of the long pendency of the

matter, this Writ Petition is disposed of directing the respondents 2 and 3 to settle the amount due to the petitioner as expeditiously as possible, but not later than four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
