HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 28691 OF 2015 ORDER:

The petitioner is the Fair Price Shop Dealer of Peddadugam Village, Jalumuru Mandal, Srikakulam District. While so, on the basis of the report of the Tahsildar, Jalumuru, Jalumuru Mandal, dated 4.5.2015, a show cause notice was issued to the petitioner on 12.5.2015 and the petitioner submitted his explanation on 21.5.2015. After receiving the explanation, the authorization of Fair Price Shop of the petitioner was suspended on 4.6.2015. Challenging the same, the present Writ Petition is filed.

A perusal of the order of suspension shows that the allegations against the petitioner relates to variation of quantities of Rice and Sugar. The petitioner had already submitted his explanation and only an enquiry is pending before the third respondent.

In the circumstances, this Court is not inclined to interfere with the enquiry process. But, however, the third respondent is directed to conduct the enquiry by giving an opportunity to the petitioner and pass final orders therein, within a period of 30 days from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
