THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL W.P. No. 28954 of 2022 ORDER:

This Writ Petition is filed seeking a Writ of Mandamus declaring the action of the respondents in not regularizing the services of the petitioners and also in not paying the minimum time scale of pay along with other allowances as they are discharging similar duties as that of Warden or Assistant Care Taker, as being illegal, arbitrary and in violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents to regularize the services of the petitioners in the post of Assistant Care Taker or Warden with all consequential benefits of seniority, promotions, arrears of pay and allowances, which they are entitled to.

Learned Counsel for the Writ Petitioners submits that the issue involved in this writ petition is squarely covered by the decision of the Honourable Apex Court in State of

Punjab and others v. Jagjit Sing and others1 and, therefore, it needs consideration by this Court. Learned Counsel for the petitioners further submits that on the last occasion, he sought time to file a representation before the respondents and accordingly a representation has been filed by the petitioners before the respondents on 28.10.2022. During the course of arguments, the learned Counsel appearing on either side concedes that the representation made by the petitioners on 28.10.2022 shall be disposed of by the respondents herein in the light of the prevailing position of law laid down by the Honourable Apex Court. In view of the aforesaid submission made by the learned Counsel appearing on either side, I deem it appropriate to direct the respondents herein to dispose of the representation submitted by the petitioners on 28.10.2022 strictly in accordance with law, as expeditiously as possible, 1 AIR 2016 SUPREME COURT 5176

preferably within a period of Eight (8) weeks from the date of receipt of a copy of this Order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending shall stand closed.
