HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU AS.No. 1380 of 1998 And Tr.AS.No.3463 of 2003 ORDER:

Learned counsel for the appellants submits that he was received a copy of the memo dated 09.02.2017 served by the learned counsel for the respondents stating that Smt. Kandavilli Annapurnamm-2nd respondent died intestate leaving behind two legal representatives on 22.06.2007. Learned counsel for the appellants submits that he could not get any instructions despite his best efforts and requests the Court to dismiss the appeal as abated as the contesting respondents 1 and 2 have died.

Recording the said submission of the learned counsel for the appellants, both the appeal and the transfer appeal are dismissed as abated. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this appeal shall stand closed.
