HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42031 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in Crime No.666 of 2016 on the file of Sanjeeva Reddy Nagar Police Station, Hyderabad.

Heard and perused the material available on record. 3.

It is stated in the affidavit that one Khanna Phaneendra induced one J. Rama Rao to believe that he will arrange loan amount of Rs.14 Crores with simple interest at the rate of 9% with the help of his NRI friends, and he collected two cheques for Rs.7 Crores each and blank stamped papers and also cash of Rs.25.5 lakhs from the said Rama Rao. But the said Phaneendra failed to arrange the said amount. Then, the said Rama Rao filed a civil suit against the said Phaneendra for recovery of the amount. While so, the said Rama Rao received a threatening letter from the address of the said Khanna Phaneendra with a demand to withdraw the civil suit. Then, the said Rama Rao lodged a complaint. During the course of investigation, it is revealed that the said Rama Rao and the petitioner created the said threatening letter. Hence, the said Rama Rao was arrested. Basing on the confession of the said Rama Rao, the petitioner was added as accused.

It is the grievance of the petitioner that he never committed any offence as alleged.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, in view of the fact that no

serious allegations were made against the petitioner, the official respondents are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioner. The petitioner is directed to appear before the Station House Officer concerned as and when required and he is also directed to execute a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned, as surety for his future appearance as and when required. 6.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 2nd December, 2016 Nn
