HON'BLE MRS JUSTICE ANIS SECOND APPEAL No. 1152 of 1998 JUDGMENT:

Counsel appearing for appellant is not present and there is no representation on his behalf.

On 31.3.2016, when the matter was called, counsel appearing for appellant reported that the sole appellant died and sought time till 6.4.2016 to bring legal representatives of the sole appellant on record. Again on 6.4.2016, when the matter was called, there was no representation for both sides and no legal representatives were brought on record. Hence, this Court directed to post the matter after Summer Vacation.

Till this date no steps have been taken to bring the legal representatives of the sole appellant on record. Hence, this Second Appeal is dismissed as abated. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, pending if any, shall stand closed.
