HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37711 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed to call for the records pertaining to Crime No.75 of 2016, dated 14.09.2016 on the file of Vontimitta Police Station, YSR Kadapa District and quash the same.

Heard and perused the material available on record. 3.

In the affidavit filed in support of the petition, it is stated that there are disputes between the petitioners and respondent No.4, which resulted in lodging a complaint by the 1st petitioner against respondent No.4, her husband and daughter, registered as Crime No.51 of 2016 on the file of Kadapa Women Police Station for the offences punishable under Sections 498-A, 494, 448, 324, 307 and 506 read with 34 IPC. As a counterblast, the present complaint is filed by the 4th respondent against the petitioners. 4.

Learned counsel for the petitioners submits that the petitioners are innocents of the offences alleged against them; that no specific overt acts are attributed against the petitioners; that the dispute between the petitioners and 4th respondent arise of a family dispute and hence, prays to quash the F.I.R. 5.

Considering the facts and circumstances of the case, this Court is not inclined to interfere with the investigation, however in view of submissions made by learned counsel for the petitioners that the dispute between them and 4th respondent arise out of a family dispute, the respondent-police are directed to complete the investigation in Crime No.75 of 2016 of Vontimitta Police Station, YSR Kadapa District, without arresting the petitioners, as expeditiously as possible, and file a final report, if any, either way

in accordance with law, within a period of six (6) months from today.
