THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.30630 of 2012 ORDER:

The writ petition is filed seeking the following relief/s: '..to issue a writ or direction one in the nature of Mandamus declaring the action of the respondents in prohibiting the petitioners from selling of polythene and plastic goods (carry bags, glasses etc) which is not less than 20 microns as unjust, arbitrary and consequently issue a direction to the respondents not to interfere with the business of the petitioners from selling of polythene and plastic goods (carry bags, glasses etc) which is not less than 20 microns and to pass such other order...' [Reproduced verbatim] The learned Standing Counsel appearing for the 3rd respondent had filed a counter affidavit resisting the writ petition. I have heard the submissions of the learned counsel for the parties. I have perused the material record.

While ordering notice before admission, this Court had passed an interim order on 01.10.2012 to the effect that in the event of any action being necessitated in respect of the subject matter of the writ petition, the respondents shall act in strict accordance with GOMs.No.158, Municipal Administration and Urban Development (F2) Department dated 04.04.2006 and shall strictly abide by the due process of law. At the time of hearing, both the learned counsel would submit that if the interim order passed by this court on 01.10.2012 is made the final order that would sub-serve the ends of justice.

Having regard to the submission, the Writ Petition itself is disposed of in

terms of the interim order passed by this Court on 01.10.2012. No order as to costs.

Miscellaneous petitions, pending if any, in the writ petition shall stand closed.
