Arvind Kumar v. The State Of Telangana
THE HONOURABLE SMT. JUSTICE P.MADHAVI DEVI W.P.NO.25645 OF 2021 ORDER:
This Writ Petition has been filed by the petitioner seeking 'Writ of Mandamus' declaring the inaction of the Respondents No.2 & 3 in not taking action on the representation of the petitioner dated 30.09.2021 and subsequent notice dated 06.10.2021 for restoration of water supply connection to the premises bearing H.No.10-1-161, Chintal Basthi, Khairtabad, Hyderabad, with connection bearing CAN No.034407358 and/or 613295303 as arbitrary and illegal.
2.
Learned counsel for the petitioner reiterates the submissions made in the affidavit.
3.
Sri T.Sudhakar Reddy, learned Standing Counsel representing respondents No.2 & 3, has filed counter affidavit stating that the water supply to the connection bearing CAN No.034407358 and/or 613295303 has never been disconnected and that there appears to be a civil dispute between the occupants and owners of the property and the respondents 2 & 3 have no role to play in such a dispute.
4.
Taking the contentions made by learned counsel for the Respondents No. 2 & 3 that there was no disconnection of water supply, this Court is of the opinion that the Writ Petition is liable to be dismissed on this ground. However, the learned counsel for the petitioner submits that the petitioner is not getting the water supply and seeks disposal of his representation dated 30.09.2021 and also subsequent legal notice dated 06.10.2021. In view of the
-2above, the respondents No.2 & 3 are directed to dispose of the representation of the petitioner dated 30.09.2021 and also subsequent legal notice dated 06.10.2021, after giving a personal hearing to the petitioner within a period of thirty (30) days from the date of receipt of copy of this order and if it is found that the nonsupply of water to the petitioner is due to any action/inaction by the respondents 2 & 3, then they shall rectify the problem and ensure that the petitioner's water connection is restored. 5.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
